    Leasing

    The attorneys in the Leasing Practice Group are equipped to deliver solutions to all types of leasing matters. They represent a wide array of clients, working with tenants and landlords in all forms of real property lease transactions in the retail, office and industrial sectors, including, for instance, ground leases, building and space leases, sale-leasebacks and subleases.

    Navigating through every stage of a lease transaction, the Group assists with the drafting and negotiating of letters of intent and broker contracts, the negotiation of lease documents and the negotiation of ancillary agreements pertaining to the build-out or fit-up of the project. Throughout the transaction process, the Group guides clients through both the business and legal issues involved to assure a favorable and cost effective result.

    Our attorneys represent public and private companies, including owners of entertainment/lifestyle centers as well as owners of regional malls, community shopping centers, power centers, neighborhood shopping centers and mixed-use projects. The Group also represents many national brand name companies as well as local retail, restaurant and fitness center tenants.

    The Group's attorneys have experience ranging from major tenant leases and shop leases, pad leases, build-to-suit leases, reverse build-to-suit leases and ground lease transactions in retail development projects. They are skilled negotiators when dealing with development agreements, reciprocal easement agreements, maintenance agreements and other agreements common to such transactions. They routinely negotiate triple-net leases as well as complex leases involving specialized tenant fit-ups, landlord contributions, and associated rent credits dependent on the client's needs.

    The Group has broad experience counseling developers and tenants in leasing transactions for manufacturing, warehouse, distribution and "flex" spaces and its attorneys are prepared to help with issues that commonly arise in industrial lease transactions, including those issues pertaining to the use and storage of hazardous materials as well as issues surrounding railroad use and access.

    In addition to assisting both landlords and tenants with the negotiation of commission agreements, the Group also represents real estate brokerage companies and individual brokers with regard to the same issues.

    The attorneys in the Group are actively involved with trade organizations such as the International Council of Shopping Centers (ICSC), Industrial/Commercial Real Estate Women, Inc.(ICREW NJ), the National Association of Industrial and Office Properties (NAIOP) and the New Jersey Builders Association which involvement assists with our monitoring of federal and state legislative and regulatory developments concerning retail, office, industrial leasing and development issues. This involvement, together with our attorneys' depth of exposure to all varieties of real estate transactions, enables the Group to understand our clients' business objectives in relation to the current real estate market.
